Terms and conditions

These Terms and Conditions govern your use of the www.fantasyfundfootball.co.uk Website and must be read in conjunction with the game rules. Registration for the 'Game' will commence at 09:00 GMT on 07 November 2011 and will end at 23:59 on 06 March 2012. The 'Game' will go live at 09:00 GMT on 07 December 2011 and the 'Game' ends at 12:00 noon GMT on 06 April 2012. By entering Skandia Fantasy Fund Football Games you agree to be bound by these Terms

1. Definitions:

For the purposes of these Terms:
'Application' means the Application to enter a team or a Mini League in The Games;

'Banter Board' means the live chat message board within the Mini League that a Chairman owns or Team Manager is a member of;

'Chairman' means the creator and owner of a Mini League;

'Game Month' means the Game Month period. The game is divided into four 'playing' months. The Game play months will be as follows:

09:00 GMT 07 January 2012 to 12:00 GMT 06 February 2012
09:00 GMT 07 February 2012 to 12:00 GMT 06 March 2012
09:00 GMT 07 March 2012 to 12:00 GMT 06 April 2012

'Game Period' means from the Game Start (07 December 2011) to the Game End (06 April 2012);

'Lucky Dip' means a formation and choice of shirts, teams and funds that is automatically generated and selected on behalf of the Participant;

'MAM' means MoneyAM Ltd, the software owner and licensor;

'Mini League' means a group of teams created to compete as a Mini League in 'The Games';

'Mobile Site' means www.fantasyfundfootball.co.uk viewed on a Smart Phone or web enabled device;

'Participant' means a person who has entered into The Games;

'Occasional Games, Competitions and Prize Draws' means additional activity which may be added during the term of The Games;

'Occasional Prizes' means any additional prizes that are introduced as a result of any additional games, competitions or prize draws which may be added during the term of The Games;

'Refer a Friend Prize Draw Period' means from 09:00 GMT on 07 November 2011 until 12:00 GMT on 06 January 2012;

'Skandia' means Skandia Life Assurance Company Limited, Skandia MultiFUNDS Limited and Skandia MultiFUNDS Assurance Limited are registered in England & Wales under numbers 1363932, 1680071 and 4163431 respectively. Registered Office at Skandia House, Portland Terrace, Southampton SO14 7EJ, United Kingdom. All companies are authorised and regulated by the Financial Services Authority with FSA register numbers 110462, 165359 and 207977, the operators of the Game;

'Team Manager' means the Participant who creates the team;

'Team Name' means the Team Name chosen by the Participant for use in The Games;

'The Games' means the Skandia Fantasy Fund Football Game, sub-games, competitions and prize draws;

'The League' means The League in which all teams compete;

'The Main Game' means the Skandia Fantasy Fund Football Game with an 11-a-side formation;

'The Main Game Go Live' means game play goes live and leagues are open from 09:00 on 07 December 2011;

'The Main Game Period' means from 09:00 GMT on 07 December - 12:00 noon GMT on 06 April 2012;

'The Main Game Registration' means registration is open from 09:00 on 07 November 2011. Registration will end on 06 March 2012, one month from the Game end date;

'The Main Prize' means the prize awarded for the winners of the 'The Main Game';

'The Prizes' means prizes as detailed below and published on the 'Prizes' section on www.fantasyfundfootball.co.uk; All Main Game prizes will be distributed as cash.

'Website' means www.fantasyfundfootball.co.uk and any associated domains;

2. Eligibility

'How to play', and any other instructions detailed in advertisements for The Games on www.fantasyfundfootball.co.uk, any other Skandia publication (print or online) or any public Website magazine or newspaper shall form part of the Terms and Conditions of The Games. Where there is any discrepancy between different publications these Terms and Conditions will take precedence. By entering into The Games you agree to be legally bound by such Terms and Conditions. Entry to The Games is restricted to residents of the UK, Channel Islands and the Isle of Man.

All entrants to The Games must be aged 16 or over at the Start Date of The Games.

Only one entry per person is permitted. Multiple entries will be disqualified from The Games. Systematic collusion or collaboration between Team Managers may be deemed to be equivalent to multiple entries. No responsibility can be accepted for lost entries and proof of transmission will not be accepted as proof of receipt.

Team Managers can create up to five Mini Leagues of their own, but they can also be a member of 10 others. Each Mini League will have a minimum of five and a maximum of 20 accepting members. If there are less than five members in a Mini League, the Mini League is invalid.

In order to be eligible for a monthly prize the Participant must have registered and entered a team before the start date of that month's Game Month Period.

In order to be eligible for the Refer a Friend Prize the Participant must have referred a friend to the game via the online 'Invite Friends' button during the Refer a Friend Prize Draw Period.

3. Entry Rules

Skandia reserves the right to reject any Application which in Skandia's opinion does not comply with these Terms or which contravenes the spirit of The Games. Skandia has an absolute discretion to disqualify any entry/Application, or vary, amend, supplement, or waive the Terms of The Games at any time and Participants agree that no liability shall attached itself to Skandia as a result thereof and that the exercise of such discretion shall not result in any compensation being payable or paid to any Participant. It is a condition of entry that all rules are accepted as final and that the Participant agrees to abide by these Terms.

4. Registration

Entry into The Game is free. Registration to participate in The Games can only be made via the Website. Applications should be submitted using the official game site at www.fantasyfundfootball.co.uk. Incomplete registrations will not be accepted. All Participants must register by completing the 'Register' page of the Website. Information about how to register is set out on the 'Register' page of the Website. Skandia reserves the right to refuse to accept or subsequently remove any Team Manager Names that have been duplicated or are felt, in Skandia's sole discretion, to be inappropriate or offensive.

Skandia reserves the right to remove a Participant from The Games, at its absolute discretion, if they do not act in accordance with the Terms, or the spirit, of The Games. Any eligibility for The Prizes will cease immediately upon such removal from The Games in these circumstances.

Skandia will use the registration data during the course of The Games to: i) display Participants' Team Names or Mini League names on the leader board; ii) communicate with Participants about The Games, with, amongst other things, information regarding their performance, fund news and promotions within The Games, fund events, and market updates; iii) promote The Games and any future Skandia games and iv) to check Participants' eligibility for The Games and entitlement to prizes. Skandia reserves the right, at any time, to close the registration to further Participants should The Games' capacities be reached, or indeed for any other reason at its sole discretion.

When registering, Participants are agreeing to receive the monthly in-game emails, which are an integral part of the Fantasy Fund Football game.

4.1 Mini League Registration

The Chairman (Mini League creator), can invite potential Team Managers to join the game and their Mini League. The Chairman may also receive requests from others to join their Mini League. The Chairman has complete discretion over who is in their mini-league and is responsible for the content on the Banter Board.

A Chairman cannot remove Team Managers from their Mini League in the last month of the game.

5. Team and formation selection

At the start of The Main Game, on registration, a Participant (Team Manager) will choose a name for their team, a shirt colour and a team badge. There will be a Lucky Dip option for both shirt colour and team badge.

Each Team Manager will be able to invest a virtual £100,000 by building a portfolio from a universe of circa 400 funds. There will be a Lucky Dip option for building a portfolio.

The game will allocate 10% of the initial virtual money to the 'goalkeeper'; the balance would then be split between the 10 in-play funds equally with a fixed 9% investment in each.

Whether a fund is classed as a defender, midfielder or attacker will be defined by Skandia.

6. The Prizes

6.1 The Main Game Prizes

Entry to The Main Game is upon successful completion of the registration process. The Main Game runs from 09:00 GMT on 07 December 2011 until 12.00 noon GMT on 06 April 2012 when the last fund will be traded. A main Cash Prize will be awarded to the top active Team Manager with the highest fund value at the end of The Main Game. Cash prizes will also be awarded to active managers who at the end of the Main Game are positioned in second to twentieth place. Details of the prizes are stated at the beginning of these Terms and on the Prizes page of the Website.

6.2 Monthly Game prizes

At the end of each Game Month, an active Team Manager, who has participated in the Game over the full Game Month period, and who has the highest percentage return (to six decimal places) over that Game Month will receive a prize.

6.3 Mini League prizes

The winning Mini League who has the highest average team fund value at the end of the game will be awarded a prize. The prize will be awarded to the winning Mini League creator whose responsibility it will be to share the prize at their discretion.

7. Prize winners

The winners will be notified within 30 days of the closing date of each game or prize draw. All elements of The Prizes are non transferable and there are no alternative prizes. The winning Team Managers' names will be published on www.fantasyfundfootball.co.uk after the announcement of the winners.

Winners' names, locations, Game portfolio selections and photographs and any comments made in relation to a prize may be used by Skandia Group subject to the Game's privacy policy, for future promotional, marketing and publicity purposes, in all and any media worldwide without notice and without any fee being paid.

7.1 Refer a Friend

Entry into 'The Refer a Friend' Prize Draw is allowable upon successful completion of the pre-registration and Main Game Registration process. Multiple Applications are accepted providing that each referral becomes a valid Participant. Each valid referral will create an entry into the prize draw for the Team Manager that referred them. One winner of the Refer a Friend Prize Draw will be drawn at random from all valid entries received by the close of Refer a Friend Prize Draw period and will receive a cash prize.

7.2 Occasional games, prize draws and competitions

Skandia reserves the right to introduce intra-Game mini-Games, competitions and prize draws with prizes and other promotions ('Occasional Prizes') leading up to and throughout the course of the Game, and over and above the Monthly and sub-Games/promotion prizes. The criteria for winning these Occasional Prizes will be announced at the time the mini-Game/promotion is launched

8. Prize winners

Skandia or MoneyAM will contact the prize winners by phone and/or email and The Prizes will be delivered within 30 days of such notification.

Should Skandia or MoneyAM be unable to contact a winning Participant or be unable to confirm their eligibility to a prize within 30 days of the prize being awarded, then Skandia may, at its absolute discretion, determine that Participant to be ineligible for the prize concerned and instead select the Participant with the next highest percentage return as a prize winner, subject to being able to contact them and confirm their eligibility within 30 days. Skandia cannot be held responsible for incorrect Participant details that may result in The Prizes not being received.

9. Tie break for prizes

In the event of a tie for any of The Prizes, that prize will be awarded by means of a prize draw from all tied entries. The first Participant drawn at random will receive that prize. The draw will continue until the applicable prizes have been awarded or until there are no more tied Participants remaining. The prize draw will be made public.

10. Tax

Skandia will not be liable for any tax liability which is incurred by any person as a result of, or in connection with, or arising from the winning of any prize in the Game. Settlement of any tax liability will be the sole responsibility of the recipient of the prize. For the purposes of The Games, tax includes all taxes, VAT, national insurance or any other similar liabilities.

11. General

Skandia's decision in all matters relating to The Games shall be final.

Your entry and participation in The Games will be deemed to be your acceptance of these Terms.

The Prizes as described are available on the date of publication of these Terms. Events may occur that render the Game itself or the awarding of The Prizes impossible due to reasons beyond the control of Skandia and Skandia may at its absolute discretion vary or amend the Game, The Prizes or these Terms and Team Managers agree that no liability shall attach itself to Skandia as a result thereof.

Skandia will not be liable for any loss or damage whatsoever which is suffered by any person as a result of, or in connection with, or arising from The Games, any prize, or these Terms, or the use of the same except for any liability which cannot be excluded by law.

12. Jurisdiction

These Terms and Conditions shall be governed by and shall be construed in accordance with the laws of England. The courts of England shall have exclusive jurisdiction to settle any claim arising out of or in connection with these Terms and Conditions or the legal relationships established by them.

13. Mini League Banter Boards

As part of our commitment to make our Banter Boards as informative, user friendly and free from abuse as possible the following Content Standards will apply to any and all material, submissions and contributions. Your commitment to these Standards ensures a positive experience for all of our users.

The Standards

You must comply with the spirit of the following standards as well as the letter. The Standards apply to each part of any posting made by a user.
Contributions must:
be accurate where they state facts
be genuinely held where they state opinions
comply with applicable law in any country from which they are posted

Contributions must not:

- contain any personal information belonging to another person;
- contain any material which is defamatory of any other person, organisation or entity;
- contain any material which is obscene or offensive;
- infringe any copyright, database right or trade mark of any other person organisation or entity;
- be likely to deceive any person;
- be made in breach of any legal duty owed to a third party such as a contractual duty or a duty of confidence;
- be likely to harass, upset, embarrass, alarm or annoy any other person, organisation or entity;
- be likely to disrupt the game or delivery of the game in any way;
- give the impression that they emanate from Skandia or MoneyAM where this is not the case;
- advocate promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse;
- advertise any product or service without our prior written consent;

We caution against Participants or users giving out any of their personally identifiable information (such as private email address, telephone number or home address) online. This information can easily be used for illegal or harmful purposes. Please also be mindful of your fellow users and treat them with the respect and courtesy they deserve.

If we discover that you have been abusing the Banter Boards we will reprimand you, up to and including removal of your privileges, including removal from The Games and your eligibility to The Prizes and/or leave you with read only access to The Forum.

14. Investment Warning

This is a game and represents a simplified version of investing. We do not include charges such as switching charges, initial charges, financial advice charges and platform charges that you may otherwise incur when investing outside of the game.

The price of funds, shares and investments and the income derived from them can go down as well as up. Past performance cannot be relied upon as a guide to future performance.
